Effective January 1, 2027, our Terms of Use for Vessel Insight are updated as follows:

General – References to K-Sim AS ("Kongsberg") have been replaced with Kongsberg Maritime AS ("KM") following the merger by absorption of K-Sim AS into Kongsberg Maritime AS. No change to the Vessel Insight services provided to Customers results from this corporate reorganization.
General – References to "Kognifai", "Kognifai Services", "Kognifai Platform" and “Kognifai Maritime Ecosystem” have been updated to "Vessel Insight", "Vessel Insight Services", "Vessel Insight Platform" and “Vessel Insight Ecosystem” respectively. These changes are intended to align the contractual terminology with the current Vessel Insight branding and offering.
Clause 2 (Definitions) – The definition of Vessel Insight Services has been clarified to distinguish the Vessel Insight Services from KM Hardware. The definition of KM Hardware has also been updated to clarify that the hardware is supplied for use together with the Vessel Insight Services.
Clause 5 – Clarified that KM's rights to update, upgrade, enhance or otherwise change the functionality of the Vessel Insight offering, as well as the corresponding customer notification obligations for material Updates, apply to KM Hardware in addition to the Vessel Insight Platform and Vessel Insight Services.
Clause 9.1 – Clarified that the general warranty disclaimers applicable to the Vessel Insight Services and Platform do not apply to the new express hardware warranty introduced in Clause 10.2.
Clause 10 – The hardware provisions have been updated to reflect a revised ownership model for KM Hardware. KM Hardware no longer remains the property of Kongsberg Maritime and ownership is transferred to the Customer upon payment of the applicable hardware fees. The clause has also been updated to introduce an express hardware warranty covering defects in material and workmanship, including warranty terms, exclusions and available remedies.
Clause 11.2 – Updated to reflect that KM Hardware is no longer required to be returned upon termination of the Subscription Agreement. Customers are instead encouraged to return KM Hardware to Kongsberg Maritime for environmentally responsible recycling, refurbishment or disposal.
Transitional Warranty Arrangement – KM Hardware that has been delivered or made available for collection after 1 January 2026 but before 1 January 2027 will be covered by a one-time transitional warranty against defects in material and workmanship for a period of twelve (12) months commencing on 1 January 2027. The transitional warranty will be governed by the hardware warranty provisions in the updated Terms of Use, save that the warranty period shall expire on 31 December 2027 and shall not give rise to any renewed warranty period beyond that date. KM Hardware that is delivered or made available for collection after 1 January 2027 will be covered by the standard warranty regime set out in the updated Terms of Use.

Effective January 1, 2027, our Service Level Agreement (SLA) for Vessel Insight is updated as follows:

Clause 3 – Updated to clarify the Customer's responsibilities in relation to KM Hardware. Customers must contact KM Support before undertaking repairs or modifications of KM Hardware. The clause also clarifies the process for obtaining assistance in the event of hardware malfunction, damage or suspected abuse, and confirms that repair, replacement and other remedial actions will be provided in accordance with the applicable warranty provisions in the Terms of Use or, where no warranty coverage applies, on a chargeable basis as agreed between the Parties.
Clause 4 - Introduced provisions allowing KM to use remote access software for support, maintenance and related service activities. Customers may request that remote access be disabled, but this may affect the support and service levels KM can provide.
